OrganicAgent ("the Service") is an AI-powered platform for real estate agents operated by Samuel Bengisu ("the Company"). The Service provides professional websites, AI-generated social media content, automated listing video generation, lead capture and follow-up, email marketing, and CRM tools for licensed real estate agents ("Agents" or "Users").
Access to OrganicAgent requires a one-time setup fee of $2,000 and a recurring monthly subscription of $99 per agent. Subscriptions are billed monthly and automatically renew on the same date each month unless cancelled. By subscribing, you authorize OrganicAgent to charge your payment method on file for each renewal period.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information for your profile and listings. You represent that you hold a valid real estate license in your operating jurisdiction. You agree not to use the Service for any unlawful purpose or in violation of any applicable real estate regulations.
You retain ownership of all listings, photos, and personal content you upload to OrganicAgent. AI-generated content (social media posts, email campaigns, blog posts) created through the Service is owned by you once generated. You grant OrganicAgent a non-exclusive license to display your content on the platform and associated agent websites for the purpose of providing the Service.
OrganicAgent uses artificial intelligence to generate social media posts, listing descriptions, email content, and listing videos. While we strive for accuracy, AI-generated content may contain errors or inaccuracies. You are responsible for reviewing all AI-generated content before publication or distribution. OrganicAgent is not liable for any claims arising from AI-generated content that you choose to publish or distribute.
All payments are processed securely through Stripe. The one-time setup fee is non-refundable once your account has been provisioned and your website is live. Monthly subscription fees are non-refundable for the current billing period. If you believe you have been charged in error, please contact us within 30 days at support@organicagent.io.
You may cancel your subscription at any time through your dashboard billing settings or by contacting support. Upon cancellation, your account will remain active until the end of your current billing period. After cancellation takes effect, your agent website will be deactivated and AI content generation will stop. Your listing data will be retained for 90 days, during which you may request an export.
To the maximum extent permitted by law, OrganicAgent and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, resulting from your use of or inability to use the Service. Our total liability shall not exceed the amount you have paid to OrganicAgent in the twelve (12) months preceding the claim.
OrganicAgent strives to maintain high availability but does not guarantee uninterrupted service. We reserve the right to modify, suspend, or discontinue any part of the Service with reasonable notice. Scheduled maintenance windows will be communicated in advance when possible.
We may update these Terms of Service from time to time. We will notify you of material changes via email or through the platform. Your continued use of the Service after changes take effect constitutes acceptance of the updated terms.
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Palm Beach County, Florida.
